Yes­ter­day we talked about MSNBC will­ing­ness to point the fin­ger at Catholic judges on the Supreme Court say­ing that can’t couldn’t be trusted to rule fairly on the Hobby Lobby

How­ever when I got home from a badly needed absence from my PC I found this Time Mag­a­zine arti­cle lead­ing Drudge on the ladies of the court with the headline:

Supreme Court Women Raise Ques­tions on Con­tra­cep­tion Coverage

Hmmm an inter­est­ing title choice for Time mag­a­zine choice of title for time and the bold­ing of the next para­graph in the orig­i­nal was telling.

Jus­tices Kagan, Sotomayor and Gins­burg aggres­sively ques­tioned the cor­po­rate chal­lengers who want exemp­tions from pro­vid­ing con­tra­cep­tion under Oba­macare at Tuesday’s oral argu­ments. Hobby Lobby and Con­estoga Wood Spe­cial­ties say the mea­sure vio­lates their reli­gious freedoms

Hmmm again.

So the three woman on the Supreme Court made it a point to actively go after the com­pany try­ing to assert its reli­gious free­dom when the ques­tion is con­tra­cep­tion coverage.

Now Time is a pub­li­ca­tion that leans so far left it’s a won­der it doesn’t fall over on the news­stand so per­haps, Ms. Alter the author of the piece, doesn’t see it but imag­ine that same piece writ­ten for the National Review or done as a story on Fox with the con­clu­sion con­cluded that the female jus­tices could not be trusted to judge the Hobby Lobby case fairly based on their sex.

The out­rage would be never-​ending.

Now it so hap­pens that there is a grain of truth in the argu­ment in the sense that there has never been any doubt what direc­tion Jus­tices Kagan, Gins­burg and Sotomayor will take on this issue both sides of the aisle would be shocked shocked if they were part of a major­ity uphold­ing Hobby Lobby’s case.

This how­ever has as lit­tle to do with their sex as the cer­tainly in the minds of both sides that jus­tices Scalia, Thomas & Alito will be vot­ing with Hobby Lobby.

The truth is we all know the rea­son Kagan, Gins­burg and Sotomayor will almost cer­tainly vote against Hobby Lobby, it’s the same rea­son why Jus­tice Breyer likely will, because they are reli­able lib­eral votes on the court. That is the very rea­son why lib­eral pres­i­dents nom­i­nated them for the court.

And on the other end of the spec­trum that’s why Scalia, Thomas & Alito were nom­i­nated because they were con­sid­ered reli­able con­ser­v­a­tive votes by repub­li­can presidents.

Now that doesn’t mean any of them from Kagan to Alito come to their posi­tions dis­hon­estly, or with an intent to pre­judge a case, what it means is they see the law a par­tic­u­lar way and based on how they read and see it rule accord­ingly (It’s also why the wild cards on the court, Kennedy & Roberts drive peo­ple like me nuts. Kennedy because you never know where he will rule and Roberts due to evi­dence of a yel­low stain).

So lets agree to stop pre­tend­ing that the jus­tices on the court are mak­ing deci­sions because of sex­ual or reli­gious prej­u­dices and bluntly say what we all know: These jus­tices believe what they believe and gen­er­ally vote accord­ingly if they didn’t they would still be serv­ing in acad­e­mia or lower courts and you would likely never have heard their names.

Hmmm an interesting title choice for Time magazine choice of title for time and the bolding of the next paragraph in the original was telling.

Now Time is a publication that leans so far left it’s a wonder it doesn’t fall over on the newsstand so perhaps, Ms. Alter the author of the piece, doesn’t see it but imagine that same piece written for the National Review or done as a story on Fox with the conclusion concluded that the female justices could not be trusted to judge the Hobby Lobby case fairly based on their sex.

The outrage would be never-ending.
