Life goes on at the Supreme Court, vacancy or no. Last Monday, on the opening day of the term, the Court announced that it will not hear a challenge to a 2014 Tennessee ballot measure, Amendment 1, which stated “nothing in this [state] Constitution secures or protects a right to abortion.” Or, if you prefer, look at the news through the lens of The Tennessean the Justices declined to hear a challenge to “a ballot measure that eliminated the right to an abortion from the Tennessee state constitution.”

Thumbs up to the Supreme Court on this one.

The ballot measure approved by Tennessee voters four years ago was a corrective measure to a state court’s 2000 “discovery” in the state constitution of a right to abortion that was broader than the abortion rights covered under Roe v. Wade. Courts in several states have made similar rulings. The remedy to such rulings is an abortion-neutrality constitutional amendment like the one passed by Tennessee voters four years ago: nothing in our Constitution secures or protects a right to abortion. 

More from The Tennessean: the executive director of Tennessee Advocates for Planned Parenthood called Amendment 1 “another attack on women’s rights and the ability of individuals to make personal decisions for themselves.” That claim might or might not have come as a surprise to the women who made their own decisions to support Amendment 1.

According to the Family Action Council of Tennessee (FACT), a pro-life advocacy group, the passage of Amendment 1 led to swift adoption of some pro-life legislation.

During the 2015 legislative session, we made progress on a couple of measures related to Amendment 1 that were signed into law: first, a 48-hour waiting period with in-person counseling by a physician prior to an abortion, which was signed into law by Gov. Haslam on May 18, 2015, and, second, the new requirement that all clinics in Tennessee performing more than 50 surgical abortions per year be regulated as ambulatory surgery treatment centers. The new regulations took effect July 1, 2015.

So are abortions banned in Tennessee? Hardly. What Amendment 1 restored, and what the U.S. Supreme Court just tacitly endorsed, is the situation that prevailed in the Volunteer State before 2000: abortion is legal, and so are state regulations consistent with Roe.

One of the most interesting things about the collapse of the left’s case against Brett Kavanaugh is how the media left’s message has gone from

Brett Kavanaugh was a serial rapist/molester in high school/college!

to

Brett Kavanaugh was a serial drunk in high school/college!

to

Brett Kavanaugh threw ice at somebody once at College!

Now one might think that the rapidity of this transition in under a week is a shocking and surprising thing but it’s not if you consider the single most important fact of this entire exercise.

This was never supposed to get this far!

With the very first accusation the GOP and the Donald Trump White House was supposed to be in dead panic and Brett Kavanaugh was supposed to have requested to have his name withdrawn and spend his live quietly in the DC circuit with a cloud over his head.

He did not.  When asked if he would withdraw the nomination after the accusation the president answered it was a “ridiculous question

When the 2nd and the 3rd accusation came out people expected Judge Kavanaugh to request the nomination be withdrawn.

He did not, instead he went on Fox to defend himself.

When Christine Ford testified (which still surprises me today) and the media unanimously lionized said testimony the left expected Judge Kavanaugh to respond as a Michael Dukakis and meekly defend himself.

He did not, instead he called out the senators for who they were and the left for who they are.

Finally you had the left clamoring for a FBI investigation that they fully expected to not take place

Instead Jeff “Please hire me MSM as your go to anti-trump anti-gop guy” Flake suddenly went along and so now there is a full week of the various claims of these people coming now being put under a spotlight, a spotlight that they never expected to face and a spotlight that none of them can withstand.

Why?  Because none of these charges were meant to be examined, Kavanaugh was supposed to be gone, the blue wave was supposed to come in November and all of this was to remain an object lesson for any judge who might dare consent to be considered by Trump for the Supreme Court.

That why the media is reduced to this on CNN:

MSNBC anchor Andrea Mitchell fretted that the seventh FBI background check into Supreme Court nominee Brett Kavanaugh was too restricted. Her hyperventilating over the issue got to a point where she suggested that the Bureau should actually investigate Kavanaugh for being “rude” to Democrats.

Indeed this is going so bad for the left we’ve actually reached the point where we have Senator Dianne Feinstein saying this

And we’re seeing stuff like this:

and now this:

In a sworn statement provided to the Senate Judiciary Committee, a man who claims to be an ex-boyfriend of Christine Blasey Ford says that he personally witnessed Ford coach a friend on how to take a polygraph exam. If true, it would mean Ford provided false testimony to the Senate Judiciary Committee last week when she claimed she had never had any discussions with anyone about how to take a polygraph.

The troubling allegations about Ford’s polygraph history and potentially false testimony were revealed Tuesday in a letter from Sen. Chuck Grassley (R-Iowa), who chairs the Senate Judiciary Committee, to attorneys for Ford. Ford and her attorneys have thus far refused to provide all polygraph-related documents and media to the Senate for review.

This is why we’ve gone from a media meme of Kavanaugh the rapist to Kavanaugh the ice thrower.  Now the the GOP is fighting back, even against loud protesters, it’s not only the best they have and likely the best their going to get.

I can’t wait till November.

Update: Added Daredevil quote because the GOP’s sudden surge of guts is cause for Democrat concern and reminds us all that without the guts of Trump and Kavanaugh none of this happens.
