Eric Holder insists that calling ISIS islamic extremists doesn’t serve any useful purpose except for rating for FOX News:

“We spend more time, more time talking about what you call it, as opposed to what do you do about it, you know? I mean really,” Holder said with some exasperation at a National Press Club luncheon today in Washington, D.C. “If Fox didn’t talk about this, they would have nothing else to talk about, it seems to me.”

Ok I have a thought experiment for Eric Holder.

What if we don’t call “gay marriage” Marriage?

This is not as far-fetched as it might sound at the very start of the gay marriage debates quite a few of us who are opposed and still are opposed to “gay marriage” suggested that if the state & the voters wanted to recognize these unions with all the rights of marriage without actually calling it marriage, we were OK with it.

This would still be an elegant solution to the debate as far as I’m concerned.  After all why worry about what you call it as opposed to what is done about it, after as if the left didn’t talk about gay marriage they’d have nothing else to talk about right?

Over to you Mr. Attorney General & my friends on the left.

Yesterday in the media and on the internet the only subject anyone seemed to be talking about was Eric Holder’s decision to resign.

We’re written sufficiently about Mr. Holder that his misdeeds do not need to be re-listed here but there seems to be an aura of unreality in the celebratory mood at Mr Holder’s impending/eventual departure from this administration.

I don’t mean to be a party pooper, after all given Holder’s complete and utter disregard for the law and the constitution he was certainly unfit for the office he held, but in the interest of reality left me offer one basic challenge to test your political IQ:

Hands up all those who think that Barack Obama’s choice to replace Eric Holder will be a person who respects the Constitution and will vigorously enforce and uphold the laws of these United States?

This administration has proven to be the least transparent in history. It would seem that the only transparency we’re getting from this administration is unintended in nature.

On Friday, September 5th, the DOJ’s Office of Public affairs called Oversight Majority’s committee’s communications office by accident to ask for help spinning the IRS scandal and about leaking items to the press?!  What… a… bombshell. And gee, not a smidgeon of corruption there!

Breitbart has the whole story including the letter sent by Darrell Issa to Eric Holder.

Here’s the relevant bits:

The aide, Brian Fallon, is a former senior aide to Sen. Chuck Schumer (D-NY) and a well-known personality on Capitol Hill. The letter describes Fallon as “audibly shaken” when he realizes his request to leak documents to help get ahead of news stories about them was mistakenly made to the very office he was seeking to undermine. Issa believes the call was intended to be made to Democratic Rep. Elijah Cumming’s staff, the ranking member on the oversight panel, the letter said.

According to the letter, Fallon – who is not named in the letter but confirmed he made the call – asked if the aides could release the IRS scandal documents to “selected reporters” to give Fallon an “opportunity to comment publicly on it.”

Fallon explained to Issa aides that the Justice Department’s Office of Legislative Affairs had not permitted him to release the documents to the public and he wanted to get ahead of the story “before the Majority” – meaning Issa – could share it, according to the letter.

Issa aides – who had placed the call on speakerphone – were “caught off guard by the unusual nature of the call and the odd request” and asked Fallon to “e-mail the material for evaluation.”

“At this point,” Fallon “abruptly placed the call on hold for approximately three minutes.” When Fallon returned to the call, “he was audibly shaken. He immediately stated that there was a ‘change in plans’ and that there would be no effort” by DOJ to release the material early.

And further down Issa swipes at Elijah Cummings, BOOM:

Issa said he is “disturbed” by the “apparently longstanding collaboration between the Obama administration and Ranking Member Cummings’ staff to obfuscate and prejudice the Committee’s work through under-the-table coordination.”

This turn of events is evidence of how deeply corrupted this administration is and how hollow the words of President Obama really are. Then again, think about what Free Speech means to this President.

More media are former Obama administration employees than you can shake a stick at. I’m a little surprised that Fallon just didn’t call the media directly. Certainly, Jay Carney could have helped them.

While the protests and the riots were raging in Ferguson, Missouri after the shooting by a police officer of Michael Brown. a nine year-old South Side Chicago African-American boy, Antonio Smith, was shot to death near railroad tracks that mark the boundary between rival factions of the Gangster Disciples street gang.

No one has been arrested for the killing of Smith.

Yesterday the funeral for the boy was held in a modest storefront church.

Last week the funeral for Brown took place in suburban St. Louis. The Rev. Al Sharpton, a race-baiter for nearly 30 years, gave the eulogy. He was among the media figures, such as the Rev. Jesse Jackson, who has been in the racism business for nearly 50 years, who traveled to Ferguson to proclaim his outrage. President Obama’s attorney general, Eric Holder, the most reckless man to lead the Justice Department since Harry M. Daugherty in the Warren G. Harding Administration, also journeyed to St. Louis to appraise the situation.

To my knowledge none of them commented on the Smith murder. None of them were at the Smith funeral, not even Jackson, who lives on Chicago’s South Side. The only nationally-known civil rights figure who expressed outrage over the Smith killing was Father Michael Pfleger, a onetime spiritual advisor to President Obama who chipped in to a reward fund to find the boy’s murderer.

Locals on both sides of the political spectrum are calling Chicago “Chiraq,” in recognition that during some months when American forces were still fighting in Iraq, more Americans were murdered in Chicago some months than died in combat in that broken nation.

Now that’s a real outrage.

So the IRS lost two years worth of Lois Lerner’s emails? Huh.

And they are saying that it’s a hard disc error? Hmm.

And there are no servers with these emails on them? Imagine that.

And the House Ways and Means Committee Chairman has asked the…wait for it…the Department of Justice to investigate these “missing” emails? I’m sure that Attorney General Eric Holder will get right on that.

I remember when Former President Clinton’s National Security Adviser, Sandy Berger, absent-mindedly walked out o the National Archives with classified documents which had fallen into his socks. Then, one day, as he was walking around the house with the documents in hand, he tripped and dropped the documents. They, unfortunately fell into the blades of the scissors which were lying on the floor and they were turned into ribbons.

For his “unfortunate mishap,” Berger received a misdemeanor verdict of unauthorized removal and retention of classified material, was fined $50,000, placed on probation for two years and stripped of his security clearance for three years—and received no jail time. That was in 2005.

Sarcasm off.

I’m guessing that one of the Clintons wrote a check to Mr. Berger. Services rendered and all that.

There was some outcry online for a bit, but it died down and the Left took note. So did I.

Back then, it seemed to me that this brazen incident of theft and destruction of classified documents—and its outcome–was some sort of test. The Left wanted to see what it would be able to get away with, and it did indeed see. Berger basically got away with his heist and it was the proverbially harbinger of things to come.

As a result, and with the inauguration of President Obama in 2009, the Left and its primary host, the Democrat Party, have upped the ante: more theft, more egregious law-breaking and each time, the stakes become larger. The secondary host—mainstream media outlets like the New York Times–does its part by failing to report these crimes.

The perennial question remains: what are you, the People, going to do about it?

Meanwhile today the viewers of Morning Joe found themselves learning about the president’s use of Executive privilege to shield Eric Holder which necessitated talking about Fast and Furious.

This entire conversation and the death of an ATF agent must have come as a shock to their viewers who were wondering why the administration is invoking executive privilege.

Ironically, like MSNBC I was late to this story as well, my first post on it was June 28th of 2011 in a post titled “Is it Watergate yet? which starts with the line:

That weekend I had Barbara Espinosa on my WCRN’s DaTechGuy on DaRAdio to talk about this issue. (BTW she will be on my show this week in the 2nd hour WCRN during my 11 AM hour listen live at wcrnradio.com).

A little over a month later the ATF chief resigned My post on the subject was titled:

ATF chief resigns and nobody knows why

…at least nobody who follows the MSM

If you search for the words “fast and furious” on my blog you will only find 14 posts after this one and remember I was not only late to this, but I didn’t give this story much attention.

If however you do a search for “fast and furious” or “ATF GUNRUNNING SCANDAL” at Instapundit ( a former MSNBC contributor no less) you will find dozens of entries dating back to Feb 13th 2011: NRA weighs in on ATF gunrunning scandal.

Over and over I’ve seen the Morning Joe crowd scoff at “just bloggers” and tweeters who comment, yet even a “blogger and tweeter” like myself who has given this story short shift has been on this story for a year while the Morning Joe viewers are only now getting anything resembling coverage of this story and they dare to paint it as an “election year stunt”.

They could have covered this story, with their vast resources they could have done the work that a 23-year-old blogger Katie Pavlich did, or they could have interviewed her and talked about her book. They deliberately choose not to do so.

After today I don’t want to hear a single person on MSNBC or anywhere else talk about “bloggers in their pajamas” vs “real reporters”, because speaking as a blogger typing cross-legged in his bed, I find the comparison insulting to me.

Exit question: I’m listening right to my show from a year ago as I type this and one section is jumping out at me:

DaTechGuy “…This is serious stuff because Watergate nobody ever, For all that Nixon did with Watergate no one died from Watergate and we already have, we have two deaths directly connected with this…”

Barbara Espinosa: “…but you don’t just have two deaths”

DaTechGuy: “…and that’s not counting the deaths in Mexico.”

Barbara Espinosa: “Well there’s been hundreds of Mexican citizens who have been killed with these guns…”

When I reflect on how the MSM has covered for this administration for a full year I challenge my readers to consider this question:

Are we seeing today, what Watergate would have been if the president had been a Democrat beloved by the MSM?

I say yes!

Update 2: Powerline talks to a Justice Department vet who says:

Even with his fawning press, [Presdient Obama] will pay a price for this one. He knows this, meaning that the documents now to be withheld must be dynamite. They have to show either that Holder knew what was going on with Fast and Furious and approved it, or that he directly committed perjury in his Congressional testimony, or both. I just can’t see any other explanation for such a risky move.

Wasn’t the Washington Post just covering big time the 40th anniversary of Watergate? I wonder how much coverage this one will get.

Like I said, we are seeing what Watergate would look like if the MSM were all behind Nixon

10 AM EDT: deadline set by the Congress for production of Fast and Furious documents from Eric Holder.  Failure to produce said documents could result in Holder being cited for contempt.

10:15 AM EDT: Barack Obama exerted “executive privilege” over those documents.

Okay, Constitutional Law Professor, let’s get down and do some real constitutional law.  The separation of powers does enable a President to exert executive privilege over documents when they are going to a branch of government that has no use for them.  (As but one example, George Washington invoked executive privilege over documents relating to a treaty, when subpoenaed by the House, because the Senate, not the House, is the sole legislative body responsible for the ratification of treaties.)

Nevertheless, “I’m the President so what I say, goes” is not a permissible means to block Congressional investigation.  In U.S. v. Nixon, the Supreme Court denied then-President Nixon’s invocation of executive privilege.  It held that absent particularised circumstances (involving national security, military, or diplomatic secrets), executive privilege does not bar the production of documents at a criminal trial.   While such material may not be made public (and should be subject to in camera inspections, where possible), a President cannot simply refuse to hand it over, citing generalised concerns.

So Obama, please let us know exactly how Fast and Furious will implicate national security (except to cause violence at the border).  Please.  Because it seems as if it’s not a diplomatic issue with another nation, not a military issue, and not tending to harm national security in a particularised manner.

Ok I’m the Justice Department, am I concerned about the latest terror plot foiled? Am I concentrating on Wikileaks and keeping secrets safe? Apparently If I’m Eric Holder I have other priories:

Attorney General Eric Holder reiterated his resolve to prosecute hate crimes while standing behind the methods used in anti-terrorism cases during a speech Friday night before a Muslim advocacy group near San Francisco.
