One of the things that is almost axiomatic is the law moves at its own pace.

In one respect this is a good thing.  It’s very dangerous to rush to judgement before the facts are in, but in an age of rapid response, lack of patience and instant gratification the slow crawl of the law is not enough for many.

Since my living is made in the rapid response world I’m required to give more attention to other stories but there are a few stories of the law’s slow march that are worth highlighting

1.  Kimberlin vs the World:

The Brett Kimberlin suits vs Stacy McCain, Aaron Walker, W Hoge continues on, William Hoge has of course been all over it.an example

It seems most of The Dread Pro-Se Kimberlin’s legal effort these days has to do with finding the identity of Kimberlin Unmasked. This is something that he has been pursuing for months. When he cross examined me during the Hoge v. Kimberlin peace order trial in May, he asked me if I knew the identity of Kimberlin Unmasked, and I truthfully replied that I did not. Again, during the recent hearing on extension of the Hoge v. Schmalfeldt peace order, TDPK had Bill Schmalfeldt ask me if I knew the identity of Kimberlin Unmasked, and, again, I answered truthfully that I did not. Almost all of Kimberlin’s activity in the state Kimberlin v. Walker, et al. suit has centered on identifying Kimberlin Unmasked.

I’ve seen all sorts of wacko rumors circulated by Team Kimberlin that Kimberlin Unmasked is Aaron Walker or Patrick Frey or Dustyn Hughes or Jeff Dunetz or Lynn Thomas or Kender MacGowan or Lee Stranahan or Dan Collins. However, I’ve seen no evidence proving that any of those individuals is Kimberlin Unmasked.

I’d ask myself if I was Kimberlin Unmasked but given how well Sicilians keep secrets and our notorious lapses of memory in court under oath I don’t think I could rely on the answer.

Meanwhile on the case itself moves on:

Get out your popcorn again, because this will be fun.  On Monday, December 16, I filed a memorandum with the court in support of Kimberlin Unmasked’s attempt to remain anonymous.  In it I argued that Brett Kimberlin is a public figure who must offer evidence that he is not a pedophile or misogynist, and has offered absolutely no evidence of harassment.  I also argued that if he is given this information about Kimberlin Unmasked, that he can be expected to stalk and oppress that person or persons, given all that he has done to me in the past two years.  I specifically said that 1) he cost my wife and I our jobs, 2) tried to frame me for a crime, and 4) personally stalked my wife and I.

So yesterday, as Rand Paul was celebrating Festivus and airing his grievances on Twitter, Kimberlin aired his own by filling a series of motions in state court.  And Brett Kimberlin’s response?  Well, shut up, he explains.  He tries to get the whole thing struck and me sanctioned for filing it.  Yes, really.

He links the motions along with a video response:

Meanwhile the court case continues on. How will it finally end. I think it’s going to end like this scene from a Fish called Wanda with Kimberlin in the Kevin Kline Role:

The real question is Kimberlin’s goal. If the plan is to take up as much time belonging to good bloggers that could be spent on other things then it’s working perfectly. Of course he might just be a violent criminal psychopathic nut with a following of crazy fans who gets off on this kind of thing, but there is no reason those two things have to be mutually exclusive.

2.  The Amazing disappearing Rauhauser

Stacy McCain notes that Neil Rauhauser has moved on from stalking/trolling Stacy’s military son’s facebook page to playing duck doge and hide from his estranged wife

The latest weird turn in Rauhauser’s weird career is that his ex-wife evidently showed up on Twitter, complaining that Neal still owes some $47,000 in child support for the two children — now ages 17 and 13 — of their marriage, which ended a decade ago. Now, this caveat is necessary: I cannot verify that the Twitter account is his ex-wife’s nor, if it is indeed her, can I vouch for the accuracy of all she alleges.

Daily Kos reports that Neil Rauhauser has been acting like, well Rauhauser

Neal is probably not too upset people know he’s a deadbeat dad or has a history of domestic abuse and child abduction and endangerment.  He’s probably annoyed people know Mr Stranded Wind ratified a mineral lease to authorize fracking on his family’s property in North Dakota. But Neal is definitely pissed that Nancy verified he doesn’t have Aspergers as he’s claimed for years. Far from it, Nancy has documents showing her ex-husband was clinically diagnosed with Narcissistic Personality Disorder overlaid with Reactive Affective Disorder. Neal Rauhauser is a certified Sociopath.

So in the two weeks she’s been on Twitter, Neal has begun harassing Nancy, her children and her relatives with phone calls and text messages. He also did what he calls a SWAT lite and called Child Protective Services on his ex-wife. Other strange things have been happening recently too: someone attempted to hack Nancy’s eBay account, someone attempted to use her daughter’s social security number and someone accessed her son’s school records and found out where they live.

and the family is taking this stuff seriously:

Rauhauser has a warrant for his arrest, there are more coming. He is implicated in alleged SWATtings and false reports. He is armed and he is dangerous. The Security team will see that the restraining order is enforced. Any visits by Neal will result in his arrest. Should any harm come to Nancy or the Rauhauser children, the consequences will be severe. Due to Neal’s reputation, Nancy is also in touch with the FBI and Homeland Security so you can be sure the situation in real life and online is being monitored.

Talk about a war on women! Rauhauser’s reaction…

well life is full of coincidences. No matter how long he ducks the warrants remain out there. Sooner or later he will make a mistake, or a process-server will pose as an ally at an event or an actual ally will get pissed enough to give him up to his wife.

3. Whatever Happened to Lunenburg…

The question is, should this indictment have ever been brought? Which office do I go to to get my reputation back? Who will reimburse my company for the economic jail it has been in for two and a half years?

It’s been several weeks since the worm turned in Lunenburg MA where the town and football team went from national racist pariahs to the victims of the latest race hoax. The latest result in Google news search is this indignant column in the Worcester Telegram from Dianne Williamson who is outraged…:

If the graffiti was painted because authorities hadn’t acted on complaints that her son was being harassed, shame on her. Because rather than draw attention to bigotry, the incident created a forum for racists and deniers to slink out of the woodwork.

…because the latest developments it validates those who don’t share her worldview and are thus by definition “racists and deniers” Amazing how “denying” something that is false in the worldview of those to who the United States is perpetually Mississippi in 1955 on race, but the most interesting development in terms of the law is this:

Now it could be that we are awaiting police testing of the spray cans, it could be there are other developments that we aren’t aware of or it could mean that the Police Just didn’t want this to overshadow Christmas & New Years in the town.

But sooner or later something is going to happen and the law will move.  The only question left is this:  When it does it will be reported?  Or with the congressional midterms and Obamacare will the reputation of Lunenburg and their team quietly fall down the memory hole and folks who point out their innocent be labeled as “deniers”?

4.  …and Paris Tennessee

Around the same time that Lunenburg was staying home on Thanksgiving the Huffington Post wrote about Joe Williams:

The owner of a Tennessee health food store was beaten unconscious by three men in an alleged anti-gay hate crime.

As local ABC affiliate WBBJ TV is reporting, the owner of Healthy Thyme in Paris, Tenn. was also robbed of $1,200, while the suspects wrote a “three-letter homophobic slur” across his forehead in permanent marker during the alleged attack, which took place Nov. 20.

The victim, identified by Fox 17 as 32-year-old Joe Williams, told the Paris Post-Intelligencer that a man had come into the shop earlier that day and asked him about his sexuality, before responding that he could not shop there if he was gay. He also said that he was called derogatory names during the beating, which took place as he was in the process of closing up the business for the night.

The advocate linked the story as did GLAAD in its daily round up Dianne Williamson didn’t manage to get around to it, likely because as a Massachusetts liberal she fixed it’s axiomatic that people in a red state like Tennessee  spend their days beating up gay heath food store owners so it was hardly worth mentioning.

It seems that was a fortunate choice on her part.

A man who told police he had been robbed and beaten at a Paris health food store a few days before Thanksgiving was arrested after he allegedly withheld information about the incident and has now been charged with filing a false report.

Joe Williams, 32, of 803 E. Wood St. was arrested Friday afternoon after turning himself in at the Henry County jail.

Stacy McCain makes the obvious point:

The apparent fakery by Williams probably won’t be reported in bold headlines by some outlets that reported the story originally.

Well the Paris Post Intelligencer with an Alexa Ranking of 3,244,731 did as did Stacy whose site is ranked  did and they have an Alexa Ranking as of Sunday 12-28 of  web site did Stacy McCain (ranked 70,567) and the daily caller (ranked 1,981).

But GLADD’s rank is millions ahead of he Paris paper (ranked 98,768 worldwide) the Advocate does much better than Stacy McCain (ranked 21,667) and while the Daily caller rank in the top 2000 worldwide is impressive the Huffington Post’s rank is in the top 100 worldwide (#66 worldwide & 20th in the US).

So while, thanks to Duck Dynasty GLAAD has had a bad month the revelation that this is yet another hate crime hoax is unlikely to be reported as widely as the base story to make GLAAD’s month worse.

And it’s just as well, we don’t want to empower those “deniers” right Dianne?

One final thought concerning  the Bullyville post on Neil Rauhauser I wrote about earlier:

Stacy McCain noted some interesting and felonious threats directed at the author of the article:

That attracted two comments from someone signing themselves as “Long John Silver,”  who had murderous things to say:

I am simply amazed that this Bullyville guy, James McGibney, is still alive. If I was listed on his website I would put a bullet in his head. It’s as simple as that. His home address has been posted online. And he makes scheduled public appearances.

After the first comment drew attention, “Long John Silver” added:

Did you know that over 40% of all murders each year go unsolved in the U.S.? Since I use TOR and a random person’s open WiFi, I can’t be tracked you nitwit.

There is a big or arrogance and stupidity in those comments .  There is always a way to track someone and if the task can be crowdsourced rather than paid it becomes easier.  While police or the FYI (threat of murder over interstate lines you know) have more resources there are certain methods of simple deductive reasoning that can narrow the field considerably without any help from the NSA.

Stacy of course has some thoughts:

  There was much else and you can read the whole thing. Of course, Neal Rauhauser will deny being “Long John Silver,” just as Neal always denies being any one of the numerous sockpuppet accounts (e.g., the “Gaped Crusader”) he has used to threaten, harass and smear various people over the past three years.

While his speculation on who Long John Silver is comes from experience and past history let’s not forget what the title of this post is.  Given the evidence of those two comments we can clearly deduce this: Long John Silver is NOT Sicilian:

The first clue is the initial comment. While the content of the message is consistent with a Sicilian style threat, the making of said threat in a public rather than a more private setting suggests otherwise. A Sicilian makes such a threat to a public person in a private setting so the target can acquiesce to a demand without a public loss of face. Making that threat in public increases the pressure of the target to resist.

That’s strong evidence against, however it has been known for the odd Sicilian to be hot-headed and speak impulsively in public, therefore the first comment doesn’t definitely disqualify Mr. Silver as Sicilian.

The Second comment however does, I bring in as my expert witness, Professor Henry Hill late of New York City

Key testimony:

When I heard all the noise I knew they were cops, only cops talk that way. If they had been wise guys, I wouldn’t have heard a thing, I’d be dead.

The second threat by its very existence would normally be enough to prove  Chi non è Siciliano.  The re-issuance of a threat is considered a sign of weakness a signal that the person issuing it doesn’t want to act, but the clincher is the statement about tracking.  That personally identifies Mr. Silver with the threat as opposed to the first comment that could be said to be a general statement that could be portrayed as such in a court of law.

Therefore while Stacy McCain may still be correct that Mr. Sliver might be yet another Rauhauser sock-puppet or one of his allies, we can say the following with certainty:

Long John Silver non è Siciliano.

I hate to say it but  in one respect the Kimberlin/Rauhauser crowd has been rather successful.

The primary service they, in my opinion, perform for the left is to tie up bloggers who would otherwise be promoting other stories that could expose and inconvenience their goals.  There is always the chance that bloggers hit a story,  get it promoted high enough up the food chain to be noticed and/or reported in the MSM to the general public.

This is why I believe the far left people and groups who have funded Kimberlin in the past are, again in my opinion, funding him now.

So like a scratch that can become infected it’s my opinion that Kimberlin/Rauhauser et/al basically “clean” said scratches by tying them up, either in litigation or by drawing at least some of the attention of said writers away from what his happening in the world.

Now there have been some large blogbursts on the subject including  “Everybody write about Brett Kimberlin Day”.  Stacy McCain’s posts on the subject have gotten their share of Instalanches as well but there has been one constant in all of that.

The knowledge and outrage concerning these men has remained largely in the political blogging community and hasn’t broken out to the general public or the low information voter.  We are all known within our sphere, some are even famous in those circles but we are only vaguely known to the public.  Glenn Reyonlds once described it like being a “Champion Bowler” (if you don’t believe me tell me who Earl Anthony was without doing a web search).

As long as this remains true, that the activities of  Mr. Kimberlin, Mr. Rauhauser et/al remain a topic of conversation within that bubble, they can continue to be effective, particularly if you consider who is running the Justice department these days.

Which brings us to the web site Bullyville.

As you can likely tell from the masthead and the facebook page the site is all about bullying both online and in person.  The proprietor of the site, James McGibney has fought an effective battle against those who wish to bully others both online and elsewhere. If you doubt said effectiveness “Revenge Porn King” Hunter Moore might not.

a Nevada judge finally issued a ruling on the case, proclaiming that Mr. Moore must pay Mr. McGibney $250,000 in defamation damages, as well as pay his legal fees.

We reached out to both Mr. McGibney and Mr. Moore and will update when we hear back.

Update:  Here is a statement from Mr. McGibney:

“this judgment is the least of Hunters worries. It just helped to pave the way for the class action lawsuit already in the works against him. He thinks these young girls have forgotten what he did to them; think again. And when you threaten to rape my wife while my kids watch, you’ve earned my undivided attention. Never forgive, never forget. #expectus”

While I likely disagree with Mr. McGibney on some subjects I would not doubt for one second his effectiveness, nor would I question his reach:

That being the case his new-found interest in the Kimberlin/Rauhauser crowd can’t be good for them:

If you simply Google the name Neal Rauhauser; you will quickly see what kind of man; he really is. He’s a cyber-terrorist, who is buddies with an actual convicted perjurer and domestic terrorist, who was convicted of bombing an innocent American citizen, blowing his leg off and ultimately resulting in the suicide of his victim from pain and suffering.

The same domestic terrorist who associates with and employs his ex-prison buddies who were convicted of possession of child pornography. Neal Rauhauser is considered one of the most notorious bullies on Twitter.

That is is the tame friendly part, go to the Bullyville site for the whole ten yards.

It’s bad enough for the Kimberlin/Rauhauser crowd that Bullyville took an interest in him and directed his large readership  to many Rauhauser foes in the process:

So run along and connect to a TOR node in Switzerland and create a bunch of pastebins about me that 100 people will read. By the time you’re done with that, I guarantee you over 250,000 people will have read this.

but the TYPE of readership Bullyville has that means a lot of trouble.

Bullying is a hot topic, a week can not go by where the national media doesn’t bring it up, it’s become a cause célèbre for the famous and many millions of ordinary people who likely never spend a single day on a political blog have an interest in it.

That means that like the Three Stooges when their shorts were first shown on TV, the Kimberlin/Rauhauser story is now being exposed to an entirely new audience who are not only being informed but are being directed to a series of web sites that have told their story with even more detail than Mr. McGibney and all of this is going on while the Kimberlin suit is going forward.

I suspect this marks the beginning of the end of their effectiveness. Particularly if Mr. McGibney decides to take an interest in the source of their funding which I suspect is a very interesting story indeed.

My advice at this point to the Kimberlin/Rauhauser crowd would be to ride on, to cut and run in the hopes that he doesn’t pursue this further, I suspect, however that it’s already too late.

In my last post I suggested the Kimberlin crowd was trying to create another Molly Norris perhaps instead they have another key event they want to copy

The venue received a call from a man yesterday. Guess what his name is? “Neal.”

He called to gather information about Blog Bash, knowing that all of us will be in one room for the first time ever. He tried scaring them. This is harassment and nothing short of a threat.

So they’re calling Blog Bash, normally a venue would not get over worried about a bunch of left wing stooges making a fuss. Perhaps Ali is just over-reacting, well lets tell the same story with a slightly different perspective:

Guests and sponsors of the fourth annual “Blog Bash” have been harassed by associates of convicted bomber Brett Kimberlin, the event’s organizer said Thursday.

and let not forget one important fact about said convicted bomber

In 1981, Kimberlin was sentenced to 50 years in federal prison for his crimes,

I submit and suggest that an event where “all of us will be in one room for the first time” drawing the interest of associates of a convicted Bomber is something of significance.

I think this is a huge mistake on their part, if you try to go after the odd blogger here and there online it’s pretty easy to convince a judge that it’s just some internet squabble.

However when you are harassing the organizers and venue of an event that draws significant guests from the political world and said event is held at a DC venue with some gravitas that’s a different story. Said venues tend to have security staffs, lawyers and resources that they can draw on and are not likely to let something like this just go.

Last night I discovered the Movie Occupy Unmasked was available via streaming on Netflix.

While the film was no revelation for people who have paid attention, to the average person whose only source of news comes from Bill Maher or Comedy Central or the MSM it would be the equivalent of putting on the glasses in the cult movie They Live.

Although the “star” of the movie is undoubtedly Andrew Breitbart the most prominent person in the movie outside of Andrew is without question Lee Stranahan.

There are other prominent faces Brandon Darby, Many Nagy, David Horowitz but after Andrew, Lee is the face of the movie.

Why is this important? This isn’t the last picture that Citizen’s United will make, but it is the last one featuring Andrew Breitbart as the star. In order to get the attention of the larger public it is necessary for someone to elevate himself. The most obvious candidates are naturally the people in this film, folks like Nagy, Darby, Moncrief and of course Stranahan (I don’t count Horowitz due to age but 30 years ago it might have been him)

Lee would be a good choice for several reasons, the experience in this film, his familiarity with the left and it’s tactics, he has screen presence and the right look for the role, any attempt to paint him as part of the 1% elites is comical on its face.

If you are the left you remember the taxpayer money taken directly from the mouth of Acorn by Andrew Breitbart.

If you are the left and remember the fall of Anthony Weiner a story ignored by places like Morning Joe but featured by Breitbart until Weiner fell.

If you are the left you remember every time Andrew gave you fits.

Andrew Breitbart directly threatened the money and power of the left. The rise of a new Breitbart must be stopped, by any means necessary.

Some people might wonder why a Brett Kimberlin or a Bill Schmalfeldt or a Neal Rauhauser might go after a guy like Lee Stranahan.

I’ve been busy with my own things lately but Stacy McCain is still on the Neal Rauhauser story and noted an… interesting development at the beginning of the week:

OK, so what’s going on here? Why has someone within Anonymous started publishing these recorded phone calls and other documents?

We can speculate on motives, but my best guess is that Rauhauser is suspected of being a government snitch, and this evidence is being published by someone who is trying to make Rauhauser “radioactive” — an untouchable, an enemy of Anonymous — so that every hacker will be warned to stay away from Rauhauser.

Interesting Anonymous has a problem with Rauhauser, chooses to dump this stuff, and a few days later suddenly Stacy notes another….interesting development:

Exactly why left-wing lawyer Jay Leiderman felt it necessary to denounce Neal Rauhauser, I’m not sure. Perhaps it has something to do with the apparent suspicion among members of Anonymous that Neal Rauhauser is a paid federal informant:

Very interestingit would explain why the Kimberlin/Rauhauser stuff never seemed to make an impression on anyone with authority, Stacy continues:

As a law-abiding citizen, I am all in favor of people helping the FBI arrest criminal hackers, but the hackers at Anonymous may feel differently. Considering that one of the files posted by Anonymous includes Neal Rauhauser’s admission that he was “Carlito2000,” who helped prokoke the meltdown that sent former Anonymous spokesman Barrett Brown to federal prison . . . Well, that’s probably just a coincidence, huh?

Yes a coincidence, an interesting coincidence and I’m sure Stacy will have more actual facts as they come out but here is what jumped out at me.

Rauhauser’s actions have been well documented and commented on for a while, yet none of that was enough for Jay Liederman to abandon him. Yet Anonymous leaks information that could suggest Neal was working with the FBI and violá he is cast aside.

Perhaps Liederman, being a man of the left, considers association with the FBI, even through a second party, unwelcome. Maybe he is afraid of Anonymous, after all many are but consider.

It’s my understanding that lawyers are by definition officers of the court. That being the case am I the only person who finds this lawyer’s decision to move away from Neil Rauhauser when he is abandoned by a lawless group very ….interesting?

17 days to Christmas.

Tomorrow is December 4th the date scheduled for rules on the plethora of motions concerning Kimberlin v Walker are to be ruled on.

The Courts being what they are, it would not be a huge surprise if for whatever reason a continuance takes place to delay it, but lets work under the assumption for a moment that this is not the case.

With the election I have given a lot less attention to this story, except for noting the foolishness of tangling with Robert Stacy McCain.

But there have been several other developments worth noting.

1. Web Sites web sites where are the web sites?

You can’t have an argument on the internet if one side suddenly runs away:

Mike Stack informs us that Neal Rauhauser’s blog has disappeared, after two months of cranking out smears and conspiracy theories about the alleged evils of various enemies of Rauhauser and his client Brett Kimberlin. Meanwhile, Rauhauser’s pet Twitter troll, “Occupy Rebellion,” has switched her account to “private” setting.

It’s hard to amplify a voice that isn’t there and since there is no chance whatsoever that Rauhauser’s posts were not copied and archived by his foes I’m not sure how effective this will be in terms of hiding things from the court.

or as some have speculated it could be because of a law enforcement issue. Either way it’s not what someone who is winning the argument does.

2.  Attacking Lee Stranahan

There was a specific attack on Lee Stranahan in an attempt to gain access to his site as Patterico reports:

While monitoring the servers, it was brought to our attention that your domain, leestranahan.com, was undergoing a brute force attack. The purpose of the attack was meant to gain access to your wp-admin area, allowing an authorized person to have complete control of your site.

The email lists URLs of specific posts that have been attacked.

This isn’t a “bring him down” thing which is what you do to silence someone, this is a “take him over” thing.  That’s what happens when someone wants to erase or change the record.

Although Stacy McCain hasn’t been on the Neal Rauhauser / Brett Kimberlin kick exclusively anymore his large body of work has had an effect.

We have a letter signed by over 80 members of congress, other candidates on both sides of the aisle questioned on the issue, federal suits in the works etc etc etc.

This is bad news for the Kimberlin/Rauhauser crowd, tactics that might work when done under the radar are not as effective when done in the light of day. It leads to mistakes and as Robert Stacy McCain reports Neal Rauhauser has made a doozy:

In a thousand-word document sent to government officials, Kimberlin associate Neal Rauhauser accuses Darby of conspiring with a number of others — including employees of Republican consulting firm Hynes Communications — in an elaborate criminal scheme involving illegal so-called “SWATting” incidents aimed at four conservative bloggers: Mike Stack, Patrick “Patterico” Frey, Erick Erickson of Red State and Aaron Walker. The document (see full text below) describes Rauhauser’s accusations that the SWATting calls are “tied to an extortion attempt by Mike Grimm, Congressman from NY-13, an obstruction of justice attempt intended to deflect attention from James O’Keefe, and the whole thing is being wrapped up by Hynes Communications in an attempt to create another ‘Bill Ayers’ for the 2012 election.”

Furthermore, Rauhauser forwarded to an associate of Darby copies of e-mails he sent to a Republican member of Congress. In the e-mails he sent to the office of Rep. Sandy Adams (R-Fla.) in June and July, Rauhauser charges that Darby and others were engaged in a “conspiracy to obstruct justice.”

Rauhauser by making these statement to government officials now makes a possible suit more likely and as Glenn Reynolds put it:

the discovery process should be productive. . . .

This might be under the radar as the election gets closer but post election, I suspect there will be some nasty consequences.

While they might be advancing one particular goal this election cycle:

The thing I hate the most about my stalkers is that every moment I spend dealing with them is a moment I’m not spending on the upcoming election. It’s not just the presidential election that’s important, we need conservatives in the Senate and House if we’re going to roll back the destructive policies implemented in the past few years. I haven’t had time to write about the rematch between Rep. Ann Marie Buerkle and her uber-statist opponent Dan Maffei, or any other race, for that matter. I guess that’s all by design

which suggests a financed and deliberate strategy let me remind them of several things.

#1. There are a lot more of us then there are of them, the only reason Zilla’s list isn’t longer is it hasn’t become more known. If we can’t cover events believe me we can link to people who do.

#2. As you might have already noticed over 80 congressmen have signed a letter asking for the AG to investigate the Swattings and other members of congress have been asked about it. As bloggers continue to cover events be sure that we will continue to ask these questions of candidates. The moment someone manages to get this question asked to Mitt Romney and Answered on Camera the heat is going to be on.

#3 Although he spent a few days covering other news. Robert Stacy McCain one of the great pure reporters has devoted an incredible amount of time to this story and that information like a public fart on youtube is out there forever.

#4 This is already in the courts via this suit by Aaron Walker and others on a federal level and these suits will continue forward. They will not likely be resolved before the election but they WILL be resolved.

#5 Unless you are fast forwarding through ads as Obama has requested you might have figured out in January there is going to be a different AG and a different administration. What do you think the odds are that they will ignore the request of 80+ members of congress on this particularly since the targets of this harassment are their political allies?

And THAT’s the big point. It’s going to happen. The full force of the US legal system is going to come and it’s not going to be pretty.

That gives you three choices:

1. Stop now and hope that once this stops it is forgotten. (Unlikely if nobody else pushes it, Stacy will and the current court cases will continue).

2. Go all in figuring that your own hope is to somehow take Obama over the finish line. (Even less likely)

3. States EVIDENCE NOW! Your best chance is to do this NOW! while there is still a friendly AG in office, but it still can be done in January but I suspect you will have a harder hand against you.

You must choose, but choose wisely.

I haven’t done a lot on the Kimberlin story lately preferring to rely on Robert Stacy McCain to continue digging deeply and waiting for the other lawsuits to weave their way through the courts to their ultimate conclusion: the defeat and emasculation of the Kimberlin Machine’s attempt to silence conservatives.

There has, however been one question that I have been most interested in seeing answered but have not the time to dig into myself, namely: Does Kimberlin et/al have serious connections to higher-ups in the Democrat party and are they financing the actions in order to restrain our side during election 2012 and beyond?

I suspect that the appearance of this article at Salon might help answer that question

But most importantly, even if you don’t believe a single word Kimberlin says, no one has ever presented any evidence, at all, that Kimberlin is behind the “SWAT-ing” — at this point, they mainly insinuate it really hard. Or they claim that one of his allies is responsible. Or something. (Erick Erickson said he suspected it was a member of Kimberlin’s “fan club.”) Patterico accused two Kimberlin “associates” of being responsible, though he doesn’t even have evidence that they’re “associates.”

Now before we get to my question lets note some reactions to this piece by people who have done more than play stenographer for Kimberlin.

From Patterico post I suspect jaw is currently laying down on the floor somewhere after falling off in disbelief:

Actually, I have accused nobody. I have presented evidence. And the idea that Neal Rauhauser is not an associate of Brett Kimberlin’s is hard to square with Brett Kimberlin calling Rauhauser an “associate” in court, or Rauhauser showing up to numerous different court proceedings involving Kimberlin, handing him documents during the hearings, and such.

Is there any mention of Rauhauser’s obsession with Mike Stack, myself, and Weinergate? Any mention of the fact that Rauhauser wrote Stack at the same wrong address used by the SWATter? Any mention of the connections between Rauhauser and the “Gaped Crusader,” who threatened to “out” Aaron’s identity before it happened, published my home address, published a picture of a nude man claiming it was me, and cyberstalked several of us in other ways?

No. And Pareene never asked me about any of it.

Thus Patterico. How about Robert Stacy McCain? He not only replies with snark of a quality befitting a man who writes for money:

Well, if Alex Pareene would care to give me a phone call or send me an e-mail, perhaps we can discuss whether it is “character assassination” to suggest that the “unknown blogger” behind the “Breitbart Unmasked” site is notorious Internet menace Neal Rauhauser, who keeps showing up in Brett Kimberlin’s courtroom entourage and is almost certainly on Kimberlin’s (tax-exempt non-profit) payroll.

Pareene could call me to ask why the Kimberlin-Rauhuaser connection seemed to me newsworthy and relevant, and then I’d happily give Pareene the chance to deny that he’s a major opium distributor.

As for myself, while I would enjoy noting that the idea that Neal Rauhauser is not an associate of Brett Kimberlin is like implying I dislike hats, there is a much more significant point to note:

There is, in fact, no real plus side to defending Brett Kimberlin. At best he is a small player in the big game and even if he were more, Kimberlin & co are only effective if there is no attention to their activities.

With federal suits, the attention of bloggers around the nation, nearly 90 members of congress either signing documents against Swatting or asked about the same and Robert Stacy McCain not only continuing his revelations but getting so many instalanches it’s a wonder Charles Johnson hasn’t climbed onto a ledge, And argument for Kimberlin’s potential value and effectiveness for the left would be less plausable than the success of a national letter writing campaign in behalf of The Secret Life of Desmond Pfeiffer.

So if this is the case why on earth would Salon bring up the name of Kimberlin, let along defend him? Why would the left invest an asset that has existed for so long in such a losing endeavor? Why even if the MSM is doing their best to ignore developments even bother making the argument from the left in defense of the speedway bomber a figure that a party might not want to associate with in an election year?

There are clues to the answer.

So if Salon is not only a money loser but one that is so bad that people who were able to price Newsweek as slightly more valuable than a Wendy’s 5 piece spicy chicken nuggets couldn’t work out if it was worth as much as a Mounds Bar how does it stay alive, or perhaps the better question might be WHY does it stay alive:

it’s entirely possible that “investors” in such an enterprise don’t care how much money they lose, but are simply taking a tax write-off to support left-wing journalism. At some point, then, the calculation is more about political utility than about revenue potential.

We’ve talked the left bankrolling this kind of stuff before but the calculation assumes political utility and as I’ve noted Brett Kimberlin & Co’s values to the left is dropping in value like a Greek government bond. It’s one thing to sink millions into fighting the online battle and damn the losses, but if you are going to finance such assets why would you ever use that money to defend goods as damaged as Kimberlin & co? What is the value of such a defense?

Might it be that the connections that Stacy McCain has written about have more validity that what has already be revealed? Might it be that my speculation that Kimberlin & Company’s is funded by the left not because they were unaware of his background and tactics but because they WERE and wanted to use those tactics as a weapon in this election cycle and beyond more than mere speculation?

If such speculation was correct then it would be imperative that any evidence that would support it be inhibited at least during this critical election cycle.

I submit suggest and speculate that the left understands there is more information coming out along these lines. I submit suggest and speculate they’re trying to create a different narrative to counter it before it happens, and I further suggest that the use of Salon, an online magazine quoted by their friends and allies on MSNBC is being utilized in order to create that narrative in the MSM before an alternate one can bleed through.

I further suggest that if this Kimberlin business was just a question of a couple of minor players getting in trouble the left wouldn’t waste it’s time or an asset that it funds on it. They would just let it happen, concentrate on the election and be pleased we are writing about this rather than making fun of Obama.

What Alex Pareene and Salon are saying about Kimberlin is laughable to anyone who has actually followed this story. That they are saying it suggests there is a bigger story to tell and somebody not only doesn’t want it told but more importantly needs to preempt any possibility of it being believed or suspected by the true believers on the left or in the MSM.

One of the things that I’ve been suggesting the “Swatter” needs to turn states evidence NOW because the higher ups in Kimberlin & Co will drop him like a wet blanket when the heat gets turned up. Well guess what, somebody is turning on the stoves:

One of the things that people have been wondering have been why Democrats have been so willing to back people like Kimberlin. It doesn’t seem to make sense, well as Stacy McCain continues to peel the onion looks what turns up:

In attempting to discover the identity of “Randy Hahn,” the #StopRush boycott leader Shoq sought the services of Democrat consultant Neal Rauhauser, the e-mails obtained by The Trenches show. Rauhauser provided the group with extensive documentation about a Houston man named Jason, whose surname was redacted in the version posted by Bayne. Rauhauser then mused about exposing the man to harassment by sending his personal information to online groups.

“I have been sorely tempted to point him out to various actors — a guy like this, he could really produce some high quality entertainment for 4chan, Something Awful, Encyclopedia Dramatica, etc.,” Rauhauser wrote in his e-mail reply to Shoq.

Note we are talking an MSNBC host, and the Stop Rush movement (which Media Matters has been highly involved with this). Stacy continues to find connections higher and higher up the food chain and as things go on, the question becomes, how high can you go?

Item: Habit forming.

In a previous article Stacy McCain quoted a 2000 word scrubbed piece by Neal Rauhauser. That piece in addition to being all about hiding themselves from the law had some rather solid insights on how one identifies a person hiding behind an online identity

You have habits that include:
The time(s) of day you are active
The language you speak
The situational knowledge you have when interacting with a certain group
The software you prefer to use

I thought of this when I saw this post at Patterico:

The Gaped Crusader published a picture of a naked man and said it was me; wrote posts about my wife; published my home address; and generally made it explicitly clear that Kimberlin and Rauhauser were out to intimidate and harass folks like SWATting victim Mike Stack, me (another SWAtting victim), and Kimberlin critics Aaron Walker, Seth Allen, and Mandy Nagy.

The Gaped Crusader is a critical link between the harassment SWATting victims and an associate of Kimberlin’s.

And the Gaped Crusader is tied to Neal Rauhauser through far more than the indentation quirk above. He is also tied through subject matter obsession; quirks of language; admissions regardings recent trips . . . and an IP address.

These habits along with some odder ones are making it easier and easier to actually identify what these people have been doing and that becomes important when you consider this:

The Kimberlin guys have (among other tactics) been using lawfare to go after bloggers well turnabout is fair play:

Our first salvo in that effort has been to file a federal lawsuit today against Brett Kimberlin, seeking, in part, an injunction to prevent the state from ever again arresting Mr. Aaron Walker, an American citizen, for exercising his right to free speech, and to release him from any prior censorship restrictions imposed by unlawful judgements.

This is only the first step in what we call the “Bloggers Defense Team.” We are firmly committed to exposing and combating the efforts of Brett Kimberlin, otherwise known as the Speedway Bomber, and his well-funded allies on the left (like George Soros and Barabara Streisand) who will use any means of harassment to silence political opposition.

and the group that is doing it DB Capitol Strategies and RightSolutions are doing it well

-We plan on spending less than twenty percent of contributions on administration costs. The remainder will be spent on legal fees, lawyers, researchers, and investigators.
-In the coming days, we will create a website dedicated specifically to the effort to provide important news and information, copies of filings, and more.
-Provide monthly statements on expenditures and contributions on that website.
-Form a publicly disclosed “advisory panel” of bloggers, and disclose the methods and reasonings for that panel and those that have been included (we will also welcome suggestions).

This effort has gotten a lot of attention on the net. Combine with the efforts of the NBC on Walkers behalf and the story becoming known to Senators and Congressmen this is going to end up bad news for the left, particularly during an election year when these guys are going to be throwing anything that might weigh the down off their deflating Obama balloon.

This is not going to end well legally for Kimberlin & Co.

Update: Stacy includes two updates that are very significant, the first being a denial from attorney Imani Gandy that tells an interesting story:

How do we know that the story was legit? The proof is in the statement issued this week to The Trenches by attorney Imani Gandy.

Gandy was eager to disavow having been closely involved with the “Stop Rush” leadership, and similarly eager to deny having anything to do with the recorded phone call. Why this eagerness? Because if Shoq was in Florida when he recorded that call, the recording would be illegal under Florida law and, as Gandy is a lawyer, it would be a clear-cut ethics violation for her to be complicit in such a crime.

Yet in the process of making those denials, Gandy ended up confirming the authenticity of both the recording and the e-mails published by The Trenches — and this is important why?

Because (a) it confirms that my reporting is accurate, (b) this has the collateral effect of confirming Rauhauser’s involvement with the “Stop Rush” boycotters

That in itself is huge as it suggests the “distancing” has already begun in his second post he linked to a piece I first saw via the Lonely Conservative at Screed of Momus titled: A Conversation with Nancy. Nancy is the ex wife of Neal Rauhauser which includes this significant tidbit:

And when Neal and Nancy divorced, Neal’s antics were sufficiently disturbing enough to result in a court-ordered psychiatric evaluation. What the psychiatrist found was a man who was deeply disturbed, possessed of the worst narcissism he’d ever seen. Neal had reactive attachment disorder. He was sociopathic, and his behavior resulted in Neal facing various difficulties socially and professionally. Today, from what we’ve seen of Neal and his behavior online, the pathologies fit. The grandiosity, the unlimited ambition, the delusional sense of self-importance, and the inability to tolerate or endure any personal criticism as an individual, or any personal criticism directed at those whom Neal considers to be allies, all fit with Neal’s current and past idiopathic behavior. Only it really isn’t idiopathic, because Neal has acted like this for some time.

Hmmm this would seem to fit with what Stacy McCain has been saying right along who hypothetically asks:

Suppose there was a certain person (we’ll call him “UnSub”) who knew himself to be implicated in serious crimes. Suppose that UnSub displayed an obsessive interest in secrecy and deception. Furthermore, suppose that UnSub believed himself to be under investigation.

How would such a person behave? Is it possible — and I’m just throwing this out there, as a hypothetical possibility — that UnSub would attempt to deflect attention from himself by making accusations of wrongdoing against others? Would UnSub try to destroy or conceal potential evidence? Could we, perhaps, expect UnSub to taunt his victims or send veiled threats to potential witnesses against him?

Just kind of thinking out loud here, you understand. Purely a matter of abstract speculation, perhaps of interest to the BSU analysts at Quantico only as an exercise in psychological theory.

Maybe the BSU analysts could factor in some other variables. Say, for instance, if UnSub liked to brag about his connection to law enforcement officials, or exhibited the kind of sadistic personality that would brag about using martial arts to inflict pain on a woman.

Do you think FBI criminal profiling specialists would be interested to learn that UnSub had previously engaged in behavior “disturbing enough to result in a court-ordered psychiatric evaluation“?

The web is starting to close, to those associated I say again: States evidence NOW!

In my last post I noted the MSM is a year behind bloggers on Fast and Furious. On the Brett Kimberlin, Neal Rauhauser et/al story it looks like they will have to play catch-up as well.  Only instead of being behind the young beautiful and talented Katie Pavlich they are lagging behind the less beautiful but completely unrelenting Robert Stacy McCain

Brett Kimberlin became a “client” of Neal Rauhauser in 2011. Rauhauser has described his specialty as “solving problems in the social media work space for political campaigns and causes,” and Kimberlin had distinct “problems in the social media work space,” namely how to stop bloggers from writing about Kimberlin’s criminal past.

One should not that this “problem in the social media work space” didn’t and apparently still doesn’t apply to the MSM but unfortunately for Brett, Neal et/al Stacy McCain seems to be doing the work of 20 journalists all by his lonesome. He excerpts a 2000 word document from Rauhauser (that he scrubbed from the net) that to a techie would be worth reading for the excellent technical insights concerning online identities alone but for the purposes of this story these two bits jump out at me all emphasis mine:

The whole idea is to encapsulate an online persona in a safe environment. The VM is the container for the personality, but what if your laptop is stolen, or if you’re arrested and questioned? We run http://truecrypt.comsoftware to make encrypted file containers. Our first test involved creating a 4 gig space, binding it to drive W:, and installing Windows in a VM there. The persona in the VM is now perfectly safe if the machine is lost or stolen, so long as a strong password is used. . . .

and this

This cannot be stressed strongly enough: we have only protected against the following threats. Disclosure due to loss/theft/seizure of host computer

Hmmmm maybe it’s the Sicilian in me but am I to understand Mr. Rauhauser is giving advice to people creating false identities on how to stymie law enforcement?

Lets put this all into context:

1. You have Conservative writers and bloggers who have been Swatted because they have written about Brett Kimberlin et/al.

2. You have a Journalist who has been forced to relocate his family for their own safety for exercising his first amendment rights concerning this story.

3. You have one of the principals of this story giving advice in writing on how to keep ones activities and identities concealed from law enforcement, and then after writing these 2,000 words scrubbing them from the net.

4. You even have a possible connection to the Stop Rush Limbaugh Movement where its head Mr. Eddlestein worries:

“that someone had discovered “one of my plant names that I use on the web to confuse the Right.”

Exactly the type of thing that Mr. Rauhauser was giving advice on.

Any one of these items individually would be we call a STORY. A newsworthy story. and as I said in this week’s under the fedora column at the Conservatory, the Minority Report and Conservatively Speaking

There are now, thousands to tens of thousands of people who had no idea who Brett Kimberlin & Neal Rauhauser et/al were 60 days ago. They do today due to the now nomadic Robert Stacy McCain.

It’s said that one needs to hit rock bottom before recovery can begin, the MSM still has a way to go. The question remains if they will decide to cover this story before they are forced to by events beyond their control?

If they do then once again we will have the spectacle of their remaining viewership looking on in amazement as people go to jail for something they never heard of…

… and wondering why?

I think the answer to both is yes, but the fact both questions can be credibly asked is a disgrace in itself.

Yesterday evening just after I finished talking to the IRS  I noted I had missed a call from Ali Akbar and gave him a ring.

Ali expressed concern about Ladd Ehlinger Post that I had retweeted late last night concerning him and Paul Lemmen.

Some background. I’ve known Ali since the Scott Brown race and he has treated me well, the very first press credential I had, came from Ali. I think Ali is a talented young man who has a future and I have a very high opinion of his mother who I met at the last Blogcon. Blogbash at CPAC.

We Sicilians tend to remember that kind of thing so when Ali asked me if I would interview him on this matter, although I frankly thing this entire post is ill advised, I agreed.

Before we began I told Ali about my own relationships with the others involved in this conversation. Paul Lemmen & Ladd Ehlinger.

I have regularly linked to Paul Lemmen (although we’ve never met or spoke) I became aware of him through Zilla. Our exchanges have been unexciting but have really been just about posts.

As for Ladd Ehlinger with the exception of Stacy McCain there is nobody I’m closer to on the net. We talk regularly on issues and what is going down. He has been particularly good to me and mine. Ladd has my unequivocal friendship and trust.

Ladd does not have a high opinion of Ali. I have friends such as Sunshine State Sarah who share Ladd’s view while Stacy McCain on the other end likes Ali a lot.

Anyways Ali & I talked for a while and he made the following points concerning this dispute which is now getting some pixels:

…continues with the same remarkable success as it has for weeks as today Stacy Devotes 2414 words to Mr. Rauhauser.

Neal Rauhauser is crazy and not nearly as smart as he thinks he is, and his boastful arrogance has been his downfall before. So it is again.

This combined with the 477 words late last night, 1165 words yesterday afternoon and 1593 words yesterday morning adds up to a further 5649 devoted to Brett Kimberlin & Co in slightly over 24 hours, not to mention tweets, re-tweets and re-re-tweets of various material.

And that’s just Stacy it doesn’t include the 1743 words on June 11th, 482 words on June 12th and 1041 words I tossed in yesterday. Nor the words that continue to come from Lee Stranaham, Patterico, Dan Collins, Paul Lemmen (who has a long & rather interesting e-mail exchange with Rauhauser prompted by his decision not to back Ali Akbar) and more other bloggers than I can name.

This collected piece of work is continues to reveal the piece of work Kimberlin & Company are and continue to be. Take a look at Stacy McCain’s latest, for those who don’t want to go through 2414 works here is the meat and potatoes.

By now the astute reader understands – and I don’t really have to point this out do I? — that Kimberlin and Rauhauser’s belief in an imaginary conspiracy of their enemies led them into creating an actual conspiracy of their own.

It’s all right there, you see: Presenting himself as an agent of Velvet Revolution, Rauhauser elicited assistance from members of Anonymous in a conspiracy that “put Breitbart & Co. square in their gunsights.” What did Rauhauser mean by that expression? What manner of activity did Anonymous agree to conduct against the target “in their gunsights”? We don’t know.

What we do know is that, once more, Rauhauser’s compulsive bragging has led to the exposure of one of his schemes.

And this is coming out sooner rather than later so to the Swatter I say again State’s evidence NOW!

Update (sort of): Technically this is not a “update” since I’m typing this before the post goes live but as I’m adding this to my scheduled post I’ll label it as such.

Ladd Ehliner noted the echance between Lemmen and Rauhauser and commented on two particular entries, one where Rauhauser asserted Weiner was framed by a congressman trying to extort Jews. Ladd’s reaction to these “bombshells“:

More on Brett – locked up for bombing, freed early, received a massive false imprisonment settlement, details are sealed. The only evidence it was him was collected under hypnosis – not a valid source of evidence. They wanted it off the books and quickly, he was a convenient target.

No mention that you’re friends with Kimberlin and he’s your client, Neal? False imprisonment settlement with details sealed? In what bizzarro universe does this happen?

I’ve heard that when the Soviet Union fell apart, some writers for Pravda were totally clueless that their beloved communism was such a miserable failure. They wandered the streets, dazed zombies with no more brains to feed upon…

The danger for any propagandist is to fall prey to their own bullshit (don’t get high on your own supply). To do otherwise is to risk becoming both liar and lied-to. Yes, while the devil may indeed sprinkle bits of truth across the meals he prepares for potential victims, the arsenic renders the entire meal ultimately unpalatable.

The question becomes does Rauhauser actually believe this stuff or is he trying to play Paul or create a paper trail of deniability when this eventually gets to a court.

It will be fun to find out and trust me Stacy McCain will.

Update (sort of) 2: The Criminal case against Aaron Walker has been dropped in Maryland, waiting on the disposition of the peace order.

Dying to find out from Rauhauser how the Bavarian Illuminati managed that one.
